Under Arrest!
If you are a parent, you will probably be too shaken to think clearly when receiving news that your child has been arrested. Remember, it’s a basic right that a minor under arrest does not have to talk to the police without a parent, guardian and / or lawyer present. There may be serious legal consequences for their actions, so it is important that parents:
-
Tell the police that you are on your way and that you don't want your child questioned yet
-
Try to get the child released to your custody
-
Make an appointment with an attorney as soon as possible
-
Consider contacting:
If the child is over 18:
-
It is no less shattering for you to learn that you adult son or daughter has been arrested
-
In this instance, there is no obligation on the part of the police to notify you or have you present for questioning
-
Your child may choose to call you personally
-
Because legal penalties for adult crimes are much more severe than for juvenile crimes, you may want to hire an attorney before any questioning by police officers is permitted
